Boston Associate Jordan O’Donnell was granted summary judgment in Middlesex Superior Court. The plaintiff, a notoriously litigious individual, alleged that he slipped and fell in our client’s hotel shower because the wall-mounted soap dispenser had leaked soap onto the floor. After our summary judgment motion had been filed based on our client’s lack of notice of a defective condition, the plaintiff moved to amend his complaint, changing the theory of liability to a worn and unsafe shower floor. We successfully opposed this motion as untimely. Subsequently, the court allowed our summary judgment motion based on the lack of notice.
