Boston Partners Jim Bello and Noel Dumas successfully represented a pediatric physiatrist in an arbitration. The plaintiff was the estate of a 16-year old child who passed away from a rare, progressive neurologic disorder. The child had been treated by our client, who the plaintiff alleged, administered too high a dose of an off-label drug, had not provided the parents with informed consent regarding off-label usage of the drug, and the risks associated with the usage of the drug. The judge returned a defense award last week, finding that the physiatrist was not negligent and provided informed consent.
