Morrison Mahoney Partner Noel Dumas and Associate Rachel McCloskey Forbes recently obtained a defense verdict in a two-week medical malpractice trial in Middlesex Superior Court.

The case involved a patient who alleged an emergency room physician and pain specialist physician failed to timely diagnose and treat a spinal condition which led to paralysis, and also alleged a spine surgeon was negligent for failing to prevent post-op pressure ulcers.

The defense maintained that they appropriately diagnosed patient, and proper orders resulted in the patient’s paralysis. Additionally, the defense argued that the patient was at high risk for pressure ulcers to form, and that it was an unavoidable risk of the procedure.

The plaintiff sought a large sum of damages, however the jury found no negligence on behalf of all of the defendants.
