Morrison Mahoney Partner Doug Price and Associate Brian Manikowski obtained a defense verdict following a two day jury trial in Berkshire Superior Court. The lawsuit stemmed from a ski accident in which the plaintiff claimed our client, a minor, collided with her on a ski slope, causing the plaintiff to suffer multiple injuries, including a torn ACL, MCL and knee fracture, which required surgical repair.

The plaintiff alleged that, in 2015, a defective vending machine manufactured and distributed by the clients caught fire in a local courthouse, set off sprinklers, and resulted in water damage exceeding $250,000.

Our client was an elevator service company that contracted with the property owner to provide monthly examinations and lubrications, minor adjustments as necessary, and prepare the elevator for annual state safety inspections. On the date in question, the plaintiff claimed that the elevator and the floor were uneven while she was exiting which caused her to trip and fall.
