Linda M. Smith

Linda is a partner in the Manchester office of Morrison Mahoney. She concentrates her practice in primarily tort defense, employment and professional liability cases. Linda has represented attorneys, insurance agents, accountants and home inspectors.  Linda also handles coverage disputes and interpleader complaints. She has been a litigator for more than 30 years and has been with the firm for over 20 years.

Linda began her career as an Assistant District Attorney in Middlesex County, where she prosecuted cases in Superior and District Court. While working as a prosecutor, Linda learned the value of advocacy as she fought for fairness on behalf of the victims of crime.  In that role, Linda effectively communicated with all members of the criminal justice system, a skill that continues to serve her well as she litigates cases for her professional clients.

REPRESENTATIVE EXPERIENCE

• Obtained a defense verdict after a three-day trial in a case in which the plaintiff alleged that her client assaulted him and caused him to suffer severe emotional distress after an encounter in a residential neighborhood.
• Obtained summary judgments and dismissals in numerous cases, including legal malpractice, dental malpractice, other professional malpractice matters, coverage matters, defamation and negligent infliction of emotional distress claims.
• Successfully arbitrated matters including obtaining a favorable outcome where plaintiff claimed injury when he was a passenger in his wife’s car when there was an intersection collision with her client’s truck. Linda successfully demonstrated that the plaintiff lacked credibility and obtained a finding of no liability. In another matter, Linda obtained a favorable outcome in a premises liability case, where plaintiff claimed to have tripped on a blind step while coming out of her client’s Laundromat.
