Morrison Mahoney Partner Tony Abeln and Associate Jeffrey Hangen recently secured a defense win in a medical malpractice/wrongful death trial spanning almost three weeks in Middlesex Superior Court in Massachusetts.

Tony and Jeff represented a critical care intensivist and her group in case centered on an alleged failure to properly manage a “code blue” situation, allegedly leading to the death of a patient following an emergency c-section. Tony was able to demonstrate the heroic efforts of our client and the entire code team in what was unfortunately an unsuccessful attempt to save the patient’s life from a rare, unforeseeable, and untreatable complication of pregnancy, which was corroborated by nationally known experts.

The trial was complicated by investigatory documents that wrongly suggested a failure to follow proper hospital policies by the code team and human error were involved in the patient’s death. The jury found that our client was not negligent after eight hours of deliberation.
