Morrison Mahoney Partner Joanne Hoban recently presented to the medical staff at a hospital in Central Massachusetts regarding (Emergency Medical Treatment and Labor Act) EMTALA. In her presentation, Joanne reviewed the statutory provisions of EMTALA and how they are implicated in the Emergency Department and hospital settings. She also reviewed the basic EMTALA requirements, when EMTALA applies and how the statutory provisions present in day to day treatment.
The presentation reviewed what providers should consider when assessing patients and stability for transfer, when conducting medical screening examinations and potential pitfalls. Joanne also reviewed examples of EMTALA violations published by the OIG.
