Morrison Mahoney Associate Amy Parker recently won summary judgment in an elevator case. The plaintiff alleged that he was forced to take the stairs when the three elevators in his apartment building were out of service. While ascending the stairs, he fell and sustained injuries. Amy successfully argued that that plaintiff’s accident on the stairs was not a reasonably foreseeable consequence of the elevator being out of service. Amy also argued that the plaintiff had failed to prove that the elevators were out of service due to any defect or malfunction for which the defendant should have known.
