Morrison Mahoney Associate Jessica O’Brien obtained a defendant’s verdict in Suffolk Superior Court before Judge Gordon.
Jessica represented a landlord in a premises case that involved an alleged fall down a set of concrete stairs that were in poor condition. The plaintiff had a severe foot injury that left the him with permanent disability after four surgeries. Jessica’s investigation located a witness who testified that the plaintiff told him that he did NOT fall down the stairs and was using the lawsuit to get back at the landlord for evicting him. The jury returned a verdict in less than 10 minutes, apparently concluding that although there was an injury, there was no accident.
