New Jersey Partner Christopher Martin and Associate Ryan Franco obtained a dismissal of our client from a toxic tort case involving close to 100 defendants including several Fortune 500 companies. The complaint alleged that a contractor was exposed to our client’s products both domestically and overseas, which was the cause of his Acute Myeloid Leukemia and later death. Chris and Ryan established that the decedent’s estate could not sustain the necessary causation and failed in its burden of proof as a matter of law to show that our client’s products contributed to the decedent’s condition and death. The result of these efforts was the court granting our client’s motion and entering the dismissal of our client with prejudice
