Morrison Mahoney Partner Robert Mack and Associate David Fromm recently obtained a defendant’s verdict after a four-day jury trial in Worcester Superior Court.

The plaintiff claimed that our client, a nationwide supplier of temporary fencing, negligently installed a fence around a construction site. When the plaintiff and a project manager attempted to move the fence, it fell on him injuring his neck and back.

The plaintiff submitted reports from his physicians which stated that he was disabled as a result of the accident and sought out thousands of dollars in medical bills and lost wages as a result. The defendant denied that it was negligent, showing evidence of a project manager signing off on the installation the day before the accident. The jury deliberated for 90 minutes before rendering a defense verdict.
