Morrison Mahoney Partner Joe Desmond and Associate Corey Mastin obtained a six-figure award for a pharmaceutical supplier client in a complex commercial arbitration.  The defendant nursing home was in arrears in its payments, and sought to avoid the automatic renewal clause of the contract.  It was further in breach of a prior settlement agreement between the parties concerning the balance owed.  Rather than pay the balance owed, the defendant sought to terminate the contract despite its own failure to comply with the explicit terms of the notice provision and without being current in its amounts payable, a condition precedent to termination.  The arbitrator’s award was for all amounts sought by the client, in addition to costs, attorney’s fees, and interest.
