Morrison Mahoney Of Counsel Jeff Swanson successfully obtained summary judgment in a multi-vehicle accident case, involving eight vehicles that occurred during an ice storm. Our client acknowledged to the responding police officers and during her deposition testimony that she lost control while driving on an ice-covered roadway. Despite the fact that our client lost control of her vehicle, the Court agreed with our argument that our client successfully avoided striking the other vehicles and that the loss of control of our client’s vehicle was not a proximate cause of plaintiff’s injuries.
The Court rejected the argument that the loss of control of our client’s vehicle and the fact that our client was blocking the roadway contributed to the overall chaos of the accident scene, which plaintiff alleged resulted in another vehicle striking plaintiff’s vehicle.
