Boston Partner Jim Bello won a defense verdict following a two-week trial in Middlesex County. The plaintiff was the estate of a 62-year-old man who had undergone surgery by our client, a general surgeon. Eight days after surgery, the patient died from a pulmonary embolism. The plaintiff alleged that our client failed to appropriately prophylax the patient and failed to timely diagnose and treat the pulmonary embolism. We presented testimony from two expert witnesses. After several hours of deliberations, the jury returned a defense verdict.
