Morrison Mahoney Partners Gareth Notis and Stephen Troiano recently obtained a directed verdict after four days of evidence in a jury trial in Norfolk Superior Court. The plaintiffs, a husband and wife, alleged their vehicle was struck by a parcel delivery truck in a rotary. After the plaintiffs rested, the Court allowed the defendants’ Motion for Directed Verdict. The Court ruled that the plaintiffs failed to introduce sufficient evidence that the parcel delivery company’s driver was operating the vehicle and sufficient evidence of ownership of the vehicle by the parcel delivery company. Prior to trial, Stephen convinced the Court, via Motion in Limine, to preclude two major surgeries performed on one of the plaintiffs from evidence, eliminating the majority of the plaintiffs’ medical bills from consideration by the jury.
