Morrison Mahoney Partner Douglas Price and Associate Bridget Lopez received a defense verdict after a three day jury trial in Worcester Superior Court.
The case stemmed from a motor vehicle accident in which our client rear ended a vehicle, which was then pushed into the rear of plaintiff’s vehicle. Plaintiff claimed various injuries as a result of the accident including a rotator cuff tear which her medical expert testified would require surgery. We stipulated to liability. Through various forms of evidence, including prior medical records, lay witness testimony, and expert testimony, we were able to demonstrate that this was a minor accident, and any of plaintiff’s symptoms post accident were due to pre-existing conditions. The jury returned a defense verdict finding no causation.
