Morrison Mahoney Partner Demi Sophocleous recently prevailed on an Appeal to the Appellate Division, Second Department. 

The Appellate Division affirmed the lower court’s decision awarding summary judgment to the defendant owner and dismissing the Plaintiff’s Complaint.  The Appellate Division agreed that the plaintiff offered only speculative explanations as to how the allegedly negligent snow and ice removal efforts may have caused his accident and that the plaintiff’s action in climbing over the snowbank was the sole proximate cause of the accident.
