Morrison Mahoney Partners Tony Abeln and Rachel Forbes recently obtained a defense verdict in a two-week medical malpractice trial in Suffolk Superior Court.

In their case, the patient alleged that his attending vitreoretinal surgeon allowed a fellow to perform a complex procedure for a detached retina without informed consent, and as a result, the patient suffered permanent eye injury including decrease in visual acuity and problems with depth perception and balance.

Complicating the trial, news stories ran about our client’s alleged research misconduct, withdrawn peer review articles, and separation from a local teaching hospital. Tony and Rachel were successful in precluding these matters from trial.

The jury was out for just over three hours before returning a defense verdict.
