Morrison Mahoney Partner Rob Mack and Associate David Fromm recently obtained a defendant’s verdict after a four-day jury trial in Worcester Superior Court.
The plaintiff claimed that our client, a nationwide supplier of temporary fencing, negligently installed a fence around a construction site by not supplying enough sandbags to stabilize the fence. When the plaintiff and a project manager attempted to move the fence, it fell on him injuring his neck and back.
The plaintiff submitted reports from his physicians which stated that he was disabled as a result of the accident and he would suffer debilitating headaches the rest of his life. Plaintiff submitted $15,000 in medical bills and claimed $240,000+ in lost wages. The defendant denied that it was negligent and submitted evidence that the temporary fence was assembled and installed to the specifications of the project manager who signed off on the installation the day before the accident. The jury deliberated for 90 minutes before rendering a defense verdict.
