Morrison Mahoney Partner Christopher Martin obtained a judgment of dismissal for a client of only a few months, the Ridgewood NJ Planning Board. The Board and the municipality were both sued in a matter in which mixed residential multi-family housing with commercial store development was claimed to have been improperly approved by these governmental bodies. We quickly moved for a stay on development applications, which was granted, while the court analyzed whether there was a cause of action against the Board as to the development. The court determined that there was no cause of action and the Board’s motion to dismiss was granted with prejudice. The stay was dissolved thereafter so applications may proceed without issues as to the Board’s conduct.
The prompt, cost-effective litigation was greatly appreciated by our client. Word spread due to media publicity and we were asked to interview for the Englewood Cliffs NJ Planning Board attorney position. Morrison Mahoney was selected for this position. We now have three Planning/Land Use Board attorney positions in NJ and are handling a significant amount of development matters.
