Boston Partner Grace Garcia obtained Summary Judgment on in the Federal District Court in an employment law case. Plaintiff brought suit against her former employer claiming that she was wrongfully terminated. Specifically, plaintiff claimed that her termination was contrary to the public policy exception to the employee-at-will status and that the defendant breached the standard of good faith and fair dealing as the defendant allegedly discharged the plaintiff in order to benefit financially at the plaintiff’s expense. Grace argued for the defendant employer that the plaintiff was an at-will employee who was properly terminated after an investigation. Further, she argued that the terminated did not fall into any public policy exceptions and was thus proper. In a written decision, U.S. District Court Judge O’Toole agreed and granted summary judgment to the defendant.
