Morrison Mahoney Partner Douglas Price and Associate Amanda Prosek recently obtained a defense verdict after a three-day trial in Providence Superior Court.
The case stemmed from a 2012 car accident where the vehicle operated by our client was struck by a RIPTA bus (co-defendant) pulling out of a bus stop, as our client made a right hand turn. The plaintiff, a passenger on the bus, claimed that the impact was so severe that he was thrown onto his back and suffered serious back and neck injuries.
We were able to discredit his account through the testimony of the drivers, the plaintiff’s medical records, and photographs of the vehicles showing minimal damage. We were also able to demonstrate that the plaintiff had a pre-existing history of back and neck injuries, and had medical records after the accident inconsistent with an exacerbation of the conditions. Finally, we established that the RIPTA bus driver failed to look just prior to pulling away from the bus stop. After deliberating for less than an hour, the jury found in favor of both defendants.
