Boston Partner Douglas Price won a defense verdict after a two-day jury trial in Plymouth Superior Court. The case concerned a motor vehicle accident involving a car, operated by our client, and a motorcycle, operated by the plaintiff. The plaintiff claimed that our client ran a stop sign and entered the roadway, striking his motorcycle. However, we were able to prove through the testimony of our client and a non-party witness, as well as through physical evidence, that our client’s vehicle was stopped at the edge of the travel lane as the plaintiff’s motorcycle approached. We were also able to establish that the plaintiff lost control of his motorcycle as he approached our client’s stopped vehicle, causing the accident. After a brief deliberation, the jury found that our client was not negligent.
