New York Partner Brian Heermance and Associate Chris Keenoy obtained a dismissal of a Human Rights Complaint filed against our client, a homeless shelter. Plaintiff, a resident of the shelter, filed a Complaint with the New York State Division of Human Rights charging our client with unlawful discrimination/retaliation in violation of New York’s Human Rights Law. Specifically, plaintiff alleged that the shelter and its employees failed to provide him with housing assistance due to his disability and in retaliation for a prior complaint he had filed against the shelter.
Brian and Chris established that the plaintiff was unable to present any evidence establishing discrimination by the shelter. The New York State Division of Human Rights agreed, concluding after its seven-month investigation that there was no probable cause to believe that the shelter engaged in any unlawful discrimination, and the Complaint was dismissed.
