Scott is a partner in the New Jersey office of Morrison Mahoney. With over 42 years of experience in insurance law, general liability, products liability, and construction litigation, he has substantial experience across various industries including transportation, construction, funeral, and consumer products.

Scott has written coverage opinions and has handled numerous cases involving insurance coverage matters and first party property claims, as well as having defended lessors of heavy equipment. He has litigated, drafted, and has advised clients with regard to indemnification agreements.

As part of his employment law practice Scott represents clients in litigation involving employment discrimination and wrongful termination suits. He also represents automotive repair entities in diverse legal matters including administrative hearings, regulatory matters, employment disputes and all manner of tort actions.

Additionally, Scott counsels automobile dealers and self-insureds regarding warranty claims and consumer complaints. He has been very active in defending interstate trucking entities in tort litigation.

Scott has litigated many products liability claims both in New York and in New Jersey. These cases have involved heavy machinery, including cranes and forklifts, as well as litigation involving propane systems and allegedly adulterated food products. He has defended many wrongful death actions including a triple wrongful death action in New York Supreme Court, as well as actions involving second and third degree burns, traumatic amputations and injuries from E.coli 0157:H7.

Scott is a frequent speaker for clients on topics including negligence, ethics, insurance and employment issues and has lectured at industry conventions, including the Crane Certification Association of America (CCAA). He currently serves as an appointed arbitrator in the United State District Court for the District of New Jersey.

Prior to joining the firm, Scott led a regional litigation firm handling complex matters in insurance defense and general liability.

REPRESENTATIVE EXPERIENCE

  • Summary Judgment-Premises Liability: The Supreme Court, Kings County, New York found no liability for an accident involving a curb or parking stop.
  • Summary Judgment-Contracts and Indemnification: The Superior Court, Union County, New Jersey granted our motion on behalf of Lessee finding a duty on the part of the landlord to Defend and Indemnify the Lessee.
