Daniel J. Ashby

Daniel is an associate in the Boston office of Morrison Mahoney. He concentrates his practice in the areas of professional liability and represents attorneys, real estate professionals, and insurance brokers on a variety of malpractice claims. This work ranges from pre-litigation investigations relating to his client’s liability exposure to filing and arguing appeals to combating rulings adverse to his clients.

Daniel also has an extensive practice in products liability law, where he defends clients that range from large businesses operating on an international scale to solo practitioners  against claims measured in the tens of millions of dollars in cases ranging from explosions to traumatic rollovers. He currently serves as general counsel and national trial counsel for a sports product distributor that operates throughout North America.

In his representation of businesses in OSHA investigations across the East Coast before the Appeals Court of Massachusetts, various OSHA Review Commissions, and the Consumer Product Safety Commission, Daniel successfully convinced federal and state authorities to dismiss such investigations without either a citation or penalty against his clients.

Daniel’s clients enjoy the benefit of his focused attention on their business operations as well as their opponents and competitors, as this collaboration often leads to uncovering tangible evidence that benefits the client. He skillfully provides advice that balances the company’s realities of operating a business and the desire to minimize its future liabilities.

REPRESENTATIVE EXPERIENCE

• Prevailed on a Motion for Summary Judgment brought on behalf of a manufacturer in a product liability action involving a propane explosion by establishing that post-sale modifications to the product caused the explosion.
• Prevailed on a Motion to Quash on behalf of an international manufacturer, where plaintiff sought to take advantage of California’s jury pool in a dispute centered in Missouri.
