Courtroom Success 2015-1: Boston Associate Amy B. Parker obtained summary judgment on behalf of a property owner in a premises liability case in which the plaintiff was injured when she fell down an exterior stairway located between two buildings. The plaintiff alleged that the stairway was dark due to an inoperative light, and that she did not see the bottom steps which caused her to fall. The Superior Court held that the plaintiff’s claim failed as a matter of law because the plaintiff could not establish that the property owner had either actual or constructive notice of the inoperative light. Specifically, the plaintiff could not show the length of time that the light bulb had been inoperative prior to her fall.
