Morrison Mahoney Associate Elias Papakostas recently secured a defense verdict for our client in connection with a property damage dispute with one of its insureds after a final hearing on the merits in the Manchester District Division.

Plaintiff claimed that our client should be responsible for damage to his vehicle allegedly sustained during a motor vehicle accident. At the hearing, Elias was able to demonstrate that the plaintiff’s proffered damage estimate actually pre-dated the claimed accident, that plaintiff could not prove any causal link between the accident in question and the claimed damages, and that plaintiff had been in multiple accidents in multiple vehicles, any one of which could have been animating his claim.

Plaintiff testified, was cross-examined, and offered documentary evidence allegedly in support of his claim. Elias was able to point out the numerous inconsistencies with plaintiff’s claim and convince the Court that plaintiff had failed to meet his burden of proof.  The Court issued a detailed written decision and entered judgment for our client.
